General Terms and Conditions (GTC)

By accessing our website and purchasing products through our online shop, you accept these General Terms and Conditions (GTC).

1. Scope and Provider
These GTC apply to all orders placed through the online shop at www.juwelier-mahler.com by customers worldwide.
The contractual partner is Juwelier Mahler GmbH, Effretikonerstrasse 2, 8308 Illnau‑Effretikon, Switzerland.

2. Offer and Contract Conclusion
The display of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By submitting the order, the customer makes a binding offer to conclude a contract.
The contract is concluded only when we expressly confirm the order by e‑mail (order confirmation). We are entitled to reject orders in whole or in part without stating reasons, particularly in cases of suspected abuse or inaccurate information.

3. Prices, Taxes, and Shipping Costs
All prices are displayed in Swiss Francs (CHF). Unless otherwise stated, prices include the Swiss value-added tax (VAT) but exclude shipping costs.
Shipping costs are shown separately during the checkout process and clearly displayed before order completion.
For deliveries to countries outside Switzerland, additional customs duties, fees, and import taxes may apply. These are borne by the customer and are not included in the displayed price.

4. Payment Methods and Due Date
The following payment methods are available:

  • Credit card (Visa, Mastercard)

  • Advance payment by bank transfer

For credit card payments, the amount is charged upon completion of the order.
For advance payment, the order is processed after receipt of payment. If payment is not received within 7 calendar days, the order may be cancelled.

5. Delivery and Delivery Periods
We deliver worldwide, subject to any country-specific restrictions.

Deliveries to Switzerland:
Delivery time is typically 1–2 business days after shipment.
If adjustments to the jewellery piece are requested (e.g., resizing, engraving), the delivery time may be extended. The estimated delivery time will be communicated during the checkout process or in the order confirmation.

Deliveries Abroad:
Shipping is typically handled by international carriers such as DHL or FedEx.
Due to varying transport routes and customs procedures, we cannot provide binding delivery deadlines. The actual delivery time depends on the destination country, transport duration, and customs clearance.

Delivery delays do not generally give rise to a claim for damages.

6. Shipping and Transfer of Risk
Shipping is typically insured via the transport carriers we select (e.g., Swiss Post, DHL, FedEx, or courier services).
We, Juwelier Mahler GmbH, bear sole responsibility for loss or damage to the goods during transit until delivery.
Delivery is considered completed once the parcel is personally handed over at the delivery address provided by the customer or properly delivered according to the carrier's proof of delivery (e.g., placement at a defined drop-off location or deposit at a pickup point).

7. Returns, Exchanges, and Right of Withdrawal
Under Swiss law, there is no statutory general right of withdrawal for online purchases. However, we voluntarily offer the following return policy:
The customer may return goods within 14 days after receipt.
The goods must be unworn, undamaged, and in the original packaging (including all accessories, certificates, and labels).

The right of returnExcludesticularly:

  • Personalised products (e.g., engravings, custom-made items, adjusted ring sizes)

  • Clearly worn or damaged goods

  • Items with removed protective films or labels, unless defective

The customer bears the return shipping costs and the shipping risk for the return; we recommend insured shipping.
After successful inspection of the returned item, we will refund the purchase price minus any original shipping costs using the same payment method.

 

8. Inspection of Goods and Warranty for Defects
The customer must inspect the delivered goods immediately upon receipt and notify us in writing of any defects within 3 days after delivery.
For valid defect claims, we will, at our discretion, provide replacement, repair, or refund of the purchase price against return of the goods.
Further claims are excluded within the legally permissible scope. In particular, we are not liable for normal wear and tear, improper handling, or damage caused by third parties.

 

9. Retention of Title
The goods remain the property of Juwelier Mahler GmbH until all claims arising from the purchase contract are fully paid.

 

10. Liability

We assume unlimited liability for damages resulting from intentional or grossly negligent breach of our obligations.
For slight negligence, we are liable only for direct and foreseeable damages, unless mandatory statutory provisions state otherwise.
Liability for indirect damages and consequential damages (e.g., lost profit, data loss) is excluded to the extent legally permissible.

 

11. Copyright
All contents (particularly images, texts, logos, designs) in the online shop are protected by copyright and may not be used without our express written consent.

 

12. Data Protection
The processing of personal data is conducted in accordance with our current privacy policy, available at www.juwelier-mahler.com/datenschutz, which forms an integral part of these GTC.

 

13. Applicable Law and Place of Jurisdiction
Swiss substantive law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For disputes arising from or in connection with these GTC or individual purchase contracts, the registered office of Juwelier Mahler GmbH (Illnau‑Effretikon, Switzerland) is the place of jurisdiction, unless mandatory consumer protection provisions specify otherwise.

 

14. Amendments to the GTC
We reserve the right to amend these GTC at any time. The version published on the website at the time of the order is decisive.
